Green claims (EmpCo)

Directive (EU) 2024/825 amends the Unfair Commercial Practices Directive and adds new banned practices towards consumers. Member States' rules apply from 27 September 2026 (Art. 4(1)). Denmark transposed the Directive by Act No 558 of 27 May 2025 amending the Marketing Practices Act, the Consumer Contracts Act and the Consumer Complaints Act; the amendments to the Marketing Practices Act and the Consumer Contracts Act enter into force on 27 September 2026.

Who is affected

Businesses that market products to consumers in the EU. The rules apply to business-to-consumer commercial practices.

New banned practices

  • Generic environmental claims such as "environmentally friendly" or "green" where the trader cannot demonstrate recognised excellent environmental performance relevant to the claim (Annex I, point 4a).
  • Sustainability labels that are not based on a certification scheme or established by public authorities (Annex I, point 2a).
  • Environmental claims about the entire product or the trader's entire business when they only concern a certain aspect of the product or a specific activity (Annex I, point 4b).
  • Claims that a product has a neutral, reduced or positive greenhouse gas impact based on offsetting emissions (Annex I, point 4c).
  • Presenting legal requirements as a distinctive feature of the offer (Annex I, point 10a).

How we support it

  • Product passports show data with a source and reference, not marketing. Marketing content must not sit next to PPWR label information (PPWR Art. 12(5)).
  • We have no carbon offset features, and the templates contain no fields for offset-based claims.
